1. WHAT INFORMATION DO WE COLLECT?
Personal information you disclose to us
In Short: We collect personal information that you provide to us voluntarily.
We collect personal information that you voluntarily provide to us when you register for an account on SproutIQ Garden Planner, when you participate in activities on the Services (such as creating a garden plan or saving plant data), and when you contact us with questions or feedback. All personal information that you provide to us must be true, complete, and accurate, and you should notify us of any changes to such personal information.
The personal information we collect can include:
- Account Information: When you create an account, we collect information such as your email address and a password. We may also store a username or profile name if you choose to provide one. This information is used to identify you and allow you to log in.
- Garden and Plant Data: You have the option to input a variety of data into the app to help plan your garden. This includes any custom plant information you add (for example, plant names, notes, planting dates, or growing instructions) and any content you upload, such as a photo of a seed packet or a link to a growing guide. All of this information is tied to your account so you can access it, and it remains private to you by default (unless you choose to share it).
- Location Information (Optional): You may choose to provide general location details to personalize your gardening experience. For instance, the app might ask for your area code, ZIP code, or other location input to tailor planting dates (like local frost dates) and advice to your region. You might also grant the app permission to access your device’s location. Providing this information is optional, but if you do, we will collect and use it to give location-based guidance (see “Location Data” under automatically collected information below).
- Communications and Support: If you contact us directly (for example, by email or through a support request within the app), we will collect the information you provide in your message, such as your name, email address, and the contents of your inquiry or feedback. This helps us address your questions and improve our Services.
Sensitive Information. We do not intentionally collect any sensitive personal information (such as social security numbers, financial account details, racial or ethnic origin, genetic data, health information, or biometric identifiers). We ask that you not send or share such sensitive information with us.
Information automatically collected
In Short: Some information – such as IP address and device characteristics – is collected automatically when you use our Services.
When you use the SproutIQ Garden Planner app or visit our website, we automatically collect certain information about your device and usage of the Services. This information does not reveal your identity (like your name or contact information) directly, but may include device and usage data, such as your IP address, device identifiers, browser and device characteristics, operating system, language preferences, referring URLs, country or general location, and information about how and when you use our app. This information is primarily needed to maintain the security and operation of our Services, for internal analytics, and to improve your user experience.
The information we automatically collect includes:
- Log and Usage Data: Our servers record certain data automatically when you access or use the Services. This log data may include your IP address, device information (device type, model, and unique device identifiers), browser type and settings (if applicable), and details of your activity in the app (such as features used, pages viewed, and the time and date of each action). For example, we may log when you create a new garden layout, add a plant to your list, or use the chatbot feature. We also collect crash reports or error diagnostics if the app encounters a problem, which helps us fix bugs.
- Device Data: We collect data about the device you use to access the Services. Depending on the device, this can include information like the device’s manufacturer, model, operating system and version, app version, and device identifiers (like an Apple IDFA or Android Advertising ID, if applicable). It may also include hardware settings and network provider information. This device data allows us to ensure compatibility and optimize our app for different devices, and to understand device-specific usage patterns.
- Location Data: We may collect information about your device’s approximate location. For example, we might determine location based on your IP address or, if you grant permission, through more precise means like GPS or Bluetooth signals. This helps us provide location-specific content (such as local planting calendars). You are in control of how much location information we have: you can choose to enter your location details manually in the app (like a ZIP code), allow precise geolocation, or provide no location information at all. If you do grant location permissions on your device, you can revoke them at any time in your device settings. Note that if you opt out of providing location data, some personalized features (for example, automatic climate zone or frost date calculations) may not be available.
2. HOW DO WE PROCESS YOUR INFORMATION?
In Short: We process your information to operate and improve our Services, to communicate with you, for security and fraud prevention, and to comply with legal requirements. We may also process your information for other purposes with your consent.
We use personal information for a variety of reasons, depending on how you interact with SproutIQ Garden Planner, including:
- To provide and maintain our Services. We process your information to deliver the functionality you expect from our app. For example, we use your account information to log you in and save your data; we use your garden and plant inputs to create your personalized garden layouts and schedules; and if you ask our in-app chatbot a question, we process the information in your question (and relevant context from your garden data) to generate a useful answer.
- To personalize your experience. We may process your data to tailor certain features to you. For instance, if you provide location data, we might adjust planting recommendations to your climate. If you save certain types of plants, we might highlight related tips or suggest relevant content in the app. This processing helps make the advice and guides more relevant to your needs.
- To communicate with you. We may use your information to send you service-related communications. For example, we might email you to verify your account or to alert you about important changes or updates to the app (such as changes to this policy or to the EULA). We may also respond to your inquiries or support requests using your contact information. We do not send marketing emails or newsletters unless you have explicitly subscribed to them.
- For security and fraud prevention. We process data as necessary to detect and prevent fraudulent activity or abuse of our Services. This can include monitoring login attempts, remembering your device to detect suspicious account access, or using automated tools to flag misuse of the app (for example, someone trying to scrape data or use the AI chatbot in a prohibited manner).
- To comply with legal obligations. In certain cases, we may need to process your information to comply with applicable laws or regulations. For example, we might retain certain data if required by tax law or respond to a legal request (like a subpoena or court order) by disclosing data if we’re legally obligated to do so.
- To protect vital interests. In extremely rare circumstances, we might need to process your information to protect someone’s vital interests, such as when there is an urgent safety issue. (For instance, if we received information indicating someone’s life is in danger, we might provide data to law enforcement to help prevent harm.)
If we need to process your personal information for a purpose other than those listed above, we will only do so with your consent or as otherwise required or permitted by law.
3. WHAT LEGAL BASES DO WE RELY ON TO PROCESS YOUR PERSONAL INFORMATION?
In Short: If you are located in certain regions (like the European Economic Area or United Kingdom), we rely on specific legal grounds to process your personal information.
Some laws (such as the EU’s GDPR and the UK GDPR) require us to tell you the legal bases we rely on for processing your personal information. SproutIQ Garden Planner is initially intended for users in English-speaking countries (primarily outside the EU), but if you are an EU/UK user, we will normally rely on one of the following legal bases:
- Consent. We may process your information if you have given us permission (consent) to do so for a specific purpose. For example, if you allow us to access precise location data, we treat that as consent to use that data for providing location-based features. You have the right to withdraw your consent at any time.
- Performance of a Contract. We process personal information when it’s necessary to fulfill a contract with you – for example, to provide the Services you requested. When you agree to our End User License Agreement and use the app, a contract is formed in which we agree to provide the service, and we need to process certain data (like your account and content) to uphold our end of that contract.
- Legal Obligations. We may process your information when we need to do so to comply with a legal obligation. For instance, keeping records of purchases to satisfy tax or accounting rules, or disclosing information if required by valid legal processes.
- Legitimate Interests. We may process your information when it is in our legitimate business interests to do so, and those interests are not overridden by your rights. For example, analyzing and improving the app (which might involve reviewing how users as a whole interact with features) is a legitimate interest that helps us make SproutIQ better. When we rely on this basis, we consider and balance any potential impact on your rights.
- Vital Interests. As noted, in rare cases we may need to process your information to protect vital interests (yours or someone else’s), such as preventing harm.
If you are located in Canada, we only process your personal information with your consent (implied or express) or as otherwise permitted by applicable Canadian law.
4. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?
In Short: We only share personal information when necessary to provide our Services and in specific situations described in this section. We share with categories of third parties such as service providers (for things like cloud hosting, analytics, AI processing, and payments), and we do not share your content publicly without your consent.
We may share your data with third-party companies, contractors, and service providers (“third parties”) that perform services on our behalf or help us operate the SproutIQ Garden Planner app. We only share what is necessary for them to perform these services, and we have agreements in place to ensure they protect your information and only use it for our specified purposes. These third parties will not use your personal information for their own purposes or share it further unless it’s to provide the service we’ve requested or to comply with law.
The categories of third parties we may share personal information with include:
- Cloud Hosting and Storage Providers: We use cloud infrastructure to host our application and store your data (for example, a secure cloud database that holds your account and garden information). These providers enable the app to run smoothly and allow you to access your information from your devices.
- Data Analytics Services: We may use analytics tools (such as those provided by app platforms or third-party analytics companies) to understand how users are using SproutIQ. This helps us track app performance, fix bugs, and decide what new features to build. For instance, we might share certain usage events or crash reports with these services. The data shared typically does not include your personal content, but rather metadata like what screens were visited and for how long, or general device information.
- Artificial Intelligence Service Providers: A key feature of SproutIQ Garden Planner is our intelligent gardening assistant, which uses artificial intelligence. When you ask the chatbot a question or request a growing guide, we securely send the necessary data (such as your question and relevant context from your saved garden data) to our AI partner’s API (for example, OpenAI) in order to generate a response. Important: We only share the information needed to get you a helpful answer, and we treat the AI provider as a service provider processing data on our behalf. We do not allow them to use your questions or data for any purpose other than to return the answer to you. (For more on AI, see the note below.)
- Payment Processors and App Stores: If you choose to purchase a premium subscription or any paid feature, that transaction is handled through the platform where you downloaded the app (for instance, the Apple App Store or Google Play Store). We may receive information from the app store about your purchase (such as an anonymous transaction ID or confirmation that you have subscribed) so that we can unlock premium features for your account. We do not receive or process your credit card number or other sensitive payment details; those are handled by the app store’s payment system.
- Other Service Providers: We may also use other third-party services to support the app – for example, an email service to send support or verification emails, or an authentication provider to help manage logins (if we integrate services like “Sign in with Apple/Google”). These providers would similarly get only the data needed (like your email for sending a message) and are bound to protect it.
In addition to the above, we do not share your personal information with any other individuals or with the public by default. In other words, the content you save in SproutIQ – your garden layouts, plant data, notes, and any photos or guides – is private to your account. We do not post this information publicly or make it visible to other users of the app without your explicit action or permission. If in the future we introduce social or sharing features that allow you to share your garden or tips with others, those will be completely opt-in and your content will remain private unless you choose to share it.
We also may need to share your personal information in a few other situations:
- Business Transfers: We may share or transfer your information in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of our business by another company. (We hope SproutIQ grows, but if we ever were involved in such a business change, your information would likely be one of the assets transferred to the new owner so they can continue providing the Service. If that happens, we will ensure the new owner is bound by terms protecting your data in line with this policy.)
Important Note on AI Processing: As mentioned above, SproutIQ uses an AI service (like OpenAI) to provide you with intelligent answers and personalized gardening advice. When you interact with the AI chatbot, some of your data is shared with this third-party AI provider solely for the purpose of generating the responses you see in the app. We take steps to limit what we send (for example, we might include relevant plant information from your garden if it’s needed to answer your question, but not your account email or unrelated data). While the AI provider is contractually not allowed to use your data for other purposes, any time information is processed by an AI, there is a risk that the AI’s response could include inaccuracies or inappropriate content. We cannot guarantee the correctness or safety of content generated by the AI. We do not share personally identifying details like your name or email with the AI service. However, depending on what you ask or input, the content of your query might include personal information (for instance, “My tomato plant in Austin isn’t flowering, what should I do?” inherently reveals your city and that you have a tomato plant). The AI will use that information only to formulate a response. Please avoid sharing any sensitive personal details in your queries to the AI. The answers you receive are for informational purposes and should be double-checked against reliable sources, especially before acting on any gardening advice (see our EULA for more on this). We want to be transparent that this AI integration is a form of data processing and sharing with a service provider, and we strive to do it in a privacy-conscious and secure way.
Aside from using service providers, we do not sell your personal information and we do not share it with third parties for their own marketing or advertising purposes.
5. WHAT IS OUR STANCE ON THIRD-PARTY WEBSITES?
In Short: We are not responsible for the safety or privacy of any information that you share with third parties that we link to or that are not under our control.
The SproutIQ app or website may contain links to third-party websites, online services, or other apps (for example, a link to an external growing guide or a gardening resource site). If you click on a third-party link, you will be directed to that third party’s site or service. Any information you provide on those third-party sites is not covered by this privacy notice. We do not control, and are not responsible for, the content or privacy practices of any third-party websites or services.
For example, if you follow a link within a growing guide to an external blog, any data that site collects from you (like cookies or personal info you enter there) is governed by their policies, not ours. We recommend that you review the privacy policies of any third parties you interact with.
We also don’t endorse or make any guarantees about third-party websites or services that might be linked through SproutIQ. Your browsing and interaction on any third-party website or service are at your own risk. Be sure to read their policies and contact them directly if you have any questions or concerns about how they handle your information.
6. HOW LONG DO WE KEEP YOUR INFORMATION?
In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this privacy notice, unless a longer retention period is required or permitted by law.
We will only retain your personal information for as long as your account is active or as long as it’s needed to provide you with the SproutIQ Garden Planner Services and accomplish the purposes described in this notice. For example, we keep the data you store in the app (your account info and saved garden data) until you delete it or until you delete your account, because it’s necessary for us to have that information in order to provide the service to you.
If you decide to stop using SproutIQ, you can delete your data and account (see How can you review, update, or delete your data? below for more on that). Once your account is deleted, we will remove or anonymize your personal information, except for any data we are required to keep for legal reasons.
There are some situations where we might keep data longer, including:
- Legal obligations: We might need to retain certain information if required by law or regulation. For instance, if there were financial transactions, we may keep a record of purchases for accounting and tax purposes.
- Disputes or enforcement: If we are resolving an issue with you (for example, a dispute or a troubleshooting request), or if we need to enforce our EULA or policies, we might retain relevant information until the issue is resolved.
- Backup archives: It’s possible that your data may remain in our routine backups for a short period even after deletion. We maintain secure backups to ensure our service can recover from errors or disasters. If your information is in a backup archive, we will isolate it and keep it secure, and delete or overwrite it according to our backup retention schedule (which is designed not to keep backups indefinitely).
7. HOW DO WE KEEP YOUR INFORMATION SAFE?
In Short: We aim to protect your personal information through a system of organizational and technical security measures.
We have implemented appropriate technical and organizational security measures to protect the personal information we process. This includes using encryption for data in transit to our servers (e.g., using HTTPS for network communication), secure cloud storage practices, and limiting access to personal data only to authorized personnel who need it to operate our Services. We also continually update and patch our software to address security vulnerabilities and use firewalls and monitoring to guard against potential intrusions.
However, please remember that no electronic transmission over the Internet or method of information storage can be guaranteed to be 100% secure. While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee absolute security. For example, we cannot promise that hackers or cybercriminals will never be able to defeat our security measures. You share and store your information with us at your own risk.
It’s important for you as well to take steps to secure your account. Choose a strong, unique password and keep it confidential. If you suspect any unauthorized access to your account or any security vulnerabilities, please notify us immediately at contact@neuralappworks.com so we can investigate and assist.
In summary, we are committed to protecting your data, but no security system is infallible. We encourage you to use the app in a secure environment (for instance, avoid using unsecured public Wi-Fi when entering sensitive information) and to keep your devices and app updated.
8. DO WE COLLECT INFORMATION FROM MINORS?
In Short: We do not knowingly collect data from or market to children under 13 years of age.
We do not knowingly solicit or collect personal information from children under 13. The SproutIQ Garden Planner app and its content are intended for users who are 13 years of age or older. By using the Services, you represent that you are at least 13 years old. If you are between 13 and 18 (or the age of majority in your jurisdiction), we assume that you are using SproutIQ with the knowledge and permission of your parent or guardian.
If we learn that we have inadvertently collected personal information from a child under age 13, we will take appropriate steps to delete that information promptly. This may include deleting the associated account and any data within it. If you are a parent or guardian and you become aware that your child under 13 has provided us with personal information, please contact us at contact@neuralappworks.com so that we can take action to remove the data and terminate the child’s account if applicable.
We do not specifically market the app toward children, and features of the app (including content and the AI chatbot) are geared toward a general audience interested in gardening, not young children.
Note for California minors: While our minimum age is 13, if you are a registered user in California under 18, you still have additional rights to request removal of content you have publicly posted (see the California Privacy Rights section below).
9. WHAT ARE YOUR PRIVACY RIGHTS?
In Short: In some regions (like the EEA, UK, and Canada), you have certain rights under data protection laws. These may include the right to access, correct, or delete your personal information, or to object to or restrict certain processing. You can review, change, or delete your account data at any time by using the app or contacting us.
Depending on your location and applicable laws, you may have some or all of the following privacy rights:
- Right to Access: You have the right to request confirmation of whether we are processing your personal information and to request a copy of that information. This means you can ask us to provide you with the data we have about you, which we will do in a common digital format. (For example, if you want a copy of all your garden data stored in SproutIQ, we can provide that to you upon request.)
- Right to Rectification: If you believe any personal information we have about you is incorrect or incomplete, you have the right to request that we correct or update it. You can also directly correct much of your information by logging into your account and editing it (for instance, updating a typo in your email address or correcting a plant detail in your saved data).
- Right to Erasure: You have the right to request deletion of your personal information (also known as the “right to be forgotten”). You can achieve this by deleting content within the app (and you can delete your entire account if you no longer wish to use SproutIQ). If for some reason you are unable to delete data yourself, you can contact us and request that we delete your information from our systems. Do note that there are some exceptions where we may retain data (see “How long do we keep your information” above), but we will inform you if any such exception applies.
- Right to Restrict Processing: You have the right to ask us to restrict or suspend processing of your personal information in certain circumstances. For example, if you contest the accuracy of the data or have objected to our processing (see below), you may request that we limit use of that data until your concern is resolved.
- Right to Data Portability: You have the right to obtain your personal information from us in a format that can be easily moved to another service. We can provide your data in a machine-readable format (such as JSON or CSV) upon request, so that you can port it to other applications if you desire.
- Right to Object: In certain cases, you have the right to object to our processing of your personal information. For example, if we were processing your data based on legitimate interests, you could object if you feel it impacts your rights. You also have the right to object to any direct marketing (though we currently do not use your data for marketing you). If you object where we have no overriding legitimate interest to continue using your data, we will stop processing it.
If you are in the European Economic Area (EEA) or United Kingdom (UK) and you believe we are unlawfully processing your personal information, you also have the right to lodge a complaint with your national data protection supervisory authority. You can find their contact details on the European Commission’s website or the UK Information Commissioner’s Office website, respectively.
If you are in Canada, you have similar rights to access and correct your personal information, and to withdraw consent where processing is based on consent.
To exercise any of your rights, you can contact us using the contact information provided in this notice. We will consider and respond to all requests in accordance with applicable laws. For security, we may need to verify your identity before acting on a request (we wouldn’t want to give your data to an unauthorized person). No fee is typically required to exercise your rights, but if a request is excessive or unfounded, we may charge a reasonable fee or refuse to comply (as allowed by law).
Finally, if we are processing your information based on your consent, you have the right to withdraw that consent at any time. For example, if you allowed us to use your precise location and later change your mind, you can revoke that permission in your device settings, or if you consented to receive a newsletter (again, we currently don’t send newsletters without consent), you could unsubscribe. Withdrawing consent will not affect the lawfulness of any processing we already did, but it will stop that particular processing going forward.
10. CONTROLS FOR DO-NOT-TRACK FEATURES
Most web browsers and some mobile operating systems include a “Do-Not-Track” (DNT) feature or setting that you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected.
At this time, no uniform standard for recognizing and implementing DNT signals has been finalized. Like many websites and online services, we do not currently respond to DNT browser signals or any similar mechanisms.
If a universal standard for online tracking is adopted in the future that we are required to follow, we will update this privacy notice to let you know about our new practices. In the meantime, you can use the other controls and rights described in this notice (for example, you can opt out of certain analytics by using in-app settings if available or by contacting us, and you can configure cookie preferences on our website if applicable).
Keep in mind that DNT is mainly a web browser feature. The SproutIQ Garden Planner is a mobile app, so traditional DNT signals may not apply in the same way. However, we are committed to not tracking your activities across third-party apps or websites beyond our own Services.
11. DO CALIFORNIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?
In Short: Yes. If you are a California resident, you are granted specific rights regarding access to your personal information under the California Consumer Privacy Act (CCPA) and related laws.
California Civil Code Section 1798.83 (the “Shine the Light” law) allows California residents to request information about our disclosure of certain categories of personal information to third parties for their direct marketing purposes. We do not share your personal information with third parties for their own direct marketing purposes.
The CCPA (as amended by the CPRA) provides California residents with specific rights, including the right to know about personal information collected, used, disclosed, or sold; the right to request deletion of personal information (with some exceptions); the right to opt-out of the sale or sharing of personal information; and the right to non-discrimination for exercising these rights.
Under 18 Content Removal: Additionally, if you are under 18 years of age, reside in California, and have a registered account with SproutIQ, you have the right to request removal of any content or information you have publicly posted on our Services. (At present, SproutIQ does not display user content publicly by default, but this right applies in case you ever share content publicly through our app or website.) To request removal of such data, please contact us using the contact information below, and include the email address associated with your account and a description of the content you want removed. We will make sure the content is no longer publicly visible on our Services, though please be aware that the content may remain in our systems (for example, in backups or logs) but will be disassociated from your profile.
CCPA Privacy Notice:
The California Code of Regulations defines a “resident” for CCPA purposes as: (1) every individual who is in California for other than a temporary or transitory purpose, and (2) every individual domiciled in California who is outside California for a temporary or transitory purpose. If that definition applies to you, we must provide the following information and rights:
What categories of personal information do we collect?
In the past 12 months, we have collected the following categories of personal information (as defined by the CCPA):

We may also collect personal information outside of these categories in instances where you interact with us directly, for example:
- When you request help through customer support channels (providing additional information about an issue).
- When you participate in surveys, contests, or promotions (which might include providing contact or feedback information).
- When necessary to facilitate the delivery of our Services or respond to your inquiries (like if you email us, we of course collect your email address and the content of your message to respond).
How do we use and share your personal information?
We use the personal information we collect for the business purposes described in Section 2 of this privacy notice ( “How do we process your information?” ). In short, we use it to provide and improve the SproutIQ app, to communicate with you, for security and compliance, and similar core purposes.
We share personal information with third-party service providers only for business purposes, as described in Section 4 ( “When and with whom do we share your personal information?” ). For example, we share data with our cloud hosting provider to store it, with OpenAI to process your questions (as part of our service to you), and with app stores to manage subscriptions. Each of these service providers has a contract with us that restricts how they can use your data, in compliance with the CCPA’s definition of “service provider.”
We do not sell your personal information for money. We also do not “share” it in the sense defined by the CPRA (which mostly refers to sharing for cross-context behavioral advertising). In other words, we haven’t disclosed your data to third parties for them to advertise to you. Any information disclosed to our service providers is solely for our internal purposes as described.
In the preceding 12 months:
- Sales of Personal Information: Neural Appworks, LLC (the operator of SproutIQ) has not sold any personal information to third parties. We also have not “shared” personal information for cross-context advertising.
- Disclosures for Business Purposes: Neural Appworks, LLC has disclosed the following categories of personal information to third parties for a business purpose in the last 12 months: Identifiers (such as email address to our email service provider, or device identifiers to our analytics provider); Commercial information (subscription status to the app stores); Internet/network activity (usage data to analytics services); Geolocation data (to services providing climate info, if used); and Audio/visual information (photos to our image processing service if you use that feature). These disclosures are all to service providers to help run our Service, as outlined earlier.
The categories of third parties to whom we disclosed personal information for business purposes can be found in Section 4 of this notice. They include cloud hosting providers, analytics providers, AI processing providers, and payment processors.
Your rights under the CCPA:
If you are a California resident, you have the right to:
- Request to Know: You can request that we disclose to you the categories and specific pieces of personal information we have collected about you, the categories of sources for that information, the business or commercial purpose for collecting (or sharing, if applicable) the information, and the categories of third parties with whom we share that information. Essentially, this is a more detailed overview of the personal data we have about you and what we do with it.
- Request Deletion: You can request that we delete personal information we have collected from you (with certain exceptions allowed by law). Once we receive and confirm a verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies. For example, we might retain data needed to complete a transaction you requested, to detect security incidents, or to comply with a legal obligation.
- Right to Correct: You have the right to request that we correct any inaccuracies in your personal information, taking into account the nature of the data and purposes of processing.
- Right to Opt-Out: You have the right to opt out of the processing of your personal information for purposes of targeted advertising, sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects. As mentioned, SproutIQ does not engage in these activities with your data. If we did, we would provide a clear opt-out mechanism.
- Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA rights. That means we won’t deny you our Services, charge you a different price, or provide a different level of quality just because you exercised your rights. (Do note that if you request deletion of certain data or your account, it may impact your ability to use the Service simply because the data is needed for it – but that’s a consequence of the deletion, not an intentional penalty.)
To exercise your California privacy rights, you may contact us by email at contact@neuralappworks.com. Please specify which right you intend to exercise and the scope of the request. We will need to verify your identity before fulfilling a request, which may involve asking you to provide information that matches our records.
If you have an authorized agent making a request on your behalf, we will require proof of the agent’s authorization (for example, a written permission from you). We may deny requests from agents who do not submit proof that they have been authorized by you to act on your behalf.

12. DO VIRGINIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?
In Short: Yes. If you are a Virginia resident, you may have certain rights under the Virginia Consumer Data Protection Act (CDPA).
Effective January 1, 2023, Virginia’s CDPA provides Virginia residents with rights similar in many ways to the ones we’ve described above for other jurisdictions. These include the right to confirm if we are processing your personal data, to access and obtain a copy of your data, to correct inaccuracies, to request deletion of your personal data, and to opt out of certain types of processing (like targeted advertising, sale of personal data, or certain profiling activities).
The CDPA applies to “consumers” who are Virginia residents acting in an individual or household context (not in an employment context). The law defines “personal data” as any information that is linked or reasonably linkable to an identified or identifiable person.
SproutIQ’s practices already align closely with these protections, and importantly:
- We do not sell personal data (as noted above).
- We do not process personal data for targeted advertising without consent.
- We do not use personal data for profiling in furtherance of decisions that produce legal or similarly significant effects.
If you are a Virginia resident, you can exercise the following rights:
- Confirm Processing and Access: You can request confirmation whether we are processing your personal data and request to access that data. We will provide you with the data we have, as well as details about how we use it.
- Correction: You can request that we correct any inaccuracies in your personal data, taking into account the nature of the data and purposes of processing.
- Deletion: You can request deletion of personal data you provided or that we collected about you. (As with other regions, there may be exceptions for data we are required to keep.)
- Data Portability: You can request a copy of the personal data you provided to us, in a portable and, if technically feasible, readily usable format (to the extent this is applicable; typically this would be similar to the data export described earlier).
- Opt Out: You have the right to opt out of the processing of your personal data for purposes of targeted advertising, the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects. As mentioned, SproutIQ does not engage in these activities with your data. If we did, we would provide a clear opt-out mechanism.
To exercise any of these rights, please contact us at contact@neuralappworks.com with your request. We will respond within 45 days as required by the law (or inform you if we need an extension). We will also need to verify your identity for security purposes, which may involve authentication steps or matching information you provide with our records.
If we decline to take action on a request, we will inform you of our justification and provide instructions for how you can appeal the decision. Virginia residents have the right to appeal our decision regarding a request, and if the appeal is denied, you may contact the Virginia Attorney General.
Neural Appworks, LLC has not sold any personal data in the past 12 months and does not intend to sell personal data of SproutIQ users. We only use personal data for purposes that are compatible with providing you the service, as described throughout this policy.
13. DO WE MAKE UPDATES TO THIS NOTICE?
In Short: Yes, we will update this notice as necessary to stay compliant with relevant laws and to reflect any changes in our practices.
We may update this privacy notice from time to time. When we make changes, we will update the “Last updated” date at the top of this privacy policy. The updated notice will be effective as soon as it is posted or otherwise made available to you through our Services.
If we make material changes to this notice, we will take reasonable steps to inform you. This might include posting a prominent notice on our website or within the app, or contacting you via the email address associated with your account. We encourage you to review this privacy notice periodically to stay informed about how we are protecting and using your information.
Your continued use of SproutIQ Garden Planner after any update to this privacy notice will signify your acceptance of the changes. If you do not agree to the updated policies, you should stop using the Services and, if you wish, delete your account and data.

15. HOW CAN YOU REVIEW, UPDATE, OR DELETE THE DATA WE COLLECT FROM YOU?
You have the right to review, update, or delete personal information that we have collected from you. Here’s how you can exercise those options:

Review or Update Your Data: If you have an account, you can log into the SproutIQ Garden Planner app to access and update much of your personal data directly. For example, you can edit your account information (like changing your email if that becomes possible in-app), or modify the content you have saved (such as correcting plant details, updating notes, or changing your location settings). Most of the data you provide in the app can be reviewed and changed by you at any time through the app’s user interface. If you need a comprehensive report of all your personal data that we have, you can request an export (see below).

Delete Your Data or Account: SproutIQ allows you to delete data that you have provided. You can remove individual items (for instance, you can delete a specific plant entry or an entire garden layout within the app). If you want to delete all of your data, you may effectively do so by removing each of your saved gardens and plants, and then contacting us to delete any remaining account information. We are working on providing a streamlined “Delete Account” feature; in the meantime, deletion may be a step-by-step process. If you need help with deletion, please contact us. When your account is deleted, all personal information associated with your account (including your email and any content you’ve provided) will be removed from our live databases. (As noted earlier, some residual data may remain in backups for a short period, but will be purged according to our backup retention policy.)

Data Export: You can request a copy of your data by emailing us at contact@neuralappworks.com from the email address associated with your SproutIQ account. We will provide you with an exported file containing your personal information and any garden data you’ve input, in a commonly used format (such as JSON or CSV). This allows you to keep a personal archive or transfer your information to another service if you wish. For security, we may need to verify your identity (for example, by confirming that you have access to the account email) before providing the data export.
To initiate a data deletion or export, or for any privacy-related requests, please contact contact@neuralappworks.com. We will respond as soon as possible, and in any event within the timeframes required by applicable law. When you contact us, please clarify what you are requesting (e.g., “I’d like to delete my account and all data” or “I’d like an export of my data”). We may ask for additional information to verify that you are the account holder.
We’re committed to helping you exercise control over your personal information. Deleting the app from your device does not by itself delete your account or data, so be sure to contact us or use the in-app deletion steps if you wish to fully remove your data from our systems.
